1. About these Terms
These Terms & Conditions apply to domestic drone roof inspections and condition reports supplied by Joseph Marshall, trading as Marshall Surveying Solutions (MSS). They should be read together with the quotation and booking confirmation. By accepting a quotation or booking an inspection, the customer agrees to these terms, subject always to their statutory consumer rights.
2. The MSS Inspection Service
An MSS Drone Roof Inspection is a visual, non-intrusive inspection of accessible and visible external roof areas using drone photography and/or video. Captured imagery is reviewed by a roofing-experienced assessor and a written condition report is prepared with photographic evidence, visible observations and recommended next steps.
The exact scope is the scope stated in the quotation or booking confirmation. Any additional service must be agreed separately.
3. Inspection Limitations
The inspection is visual and non-intrusive. Roof coverings, flashings, insulation, decks, ceilings or other building elements are not opened up, lifted or removed.
Hidden, concealed or intermittent defects may not be visible and cannot be guaranteed to be identified.
Some areas may be inaccessible or obscured because of roof geometry, neighbouring property, vegetation, structures, safe flight distances, airspace restrictions, weather, lighting or other site conditions.
The survey is not a structural survey, valuation, measured survey, guarantee of watertightness or confirmation of concealed construction unless expressly stated otherwise.
Observations reflect the visible condition and evidence available at the time of the inspection.
4. Drone Operations and Safety
All drone operations remain subject to the remote pilot's final decision. MSS may alter, postpone, limit or stop a flight where the pilot considers that weather, people, animals, vehicles, obstacles, airspace, permissions, equipment, site conditions or any other factor makes the operation unsafe, unlawful or inappropriate.
Safety and legal flight requirements take priority over obtaining any particular photograph or view.
5. Weather, Restrictions and Rescheduling
Drone inspections are weather and operational-condition dependent. If MSS cannot safely or legally complete the inspection because of unsuitable weather, airspace restrictions, site conditions or another legitimate operational reason, the appointment will be rearranged. MSS does not charge a cancellation or rescheduling fee in these circumstances.
6. Customer Responsibilities
The customer must provide accurate property and contact information, identify any particular areas of concern, disclose relevant known hazards where reasonably known, and provide or arrange any access or permission that has been agreed as necessary. The customer should ensure pets and other avoidable hazards can be kept clear of the operating area when requested.
The customer must have authority to instruct MSS to undertake the inspection at the property or obtain any permission required from the person with that authority.
7. Fees, Invoicing and Payment
The inspection fee is the amount stated in the accepted quotation. No upfront payment is required unless expressly agreed otherwise.
Following completion of the drone inspection, MSS will issue an invoice for the agreed fee. Payment is due on receipt of the invoice. The completed Roof Condition Report will be released after cleared payment has been received.
MSS is not currently VAT registered and VAT will not be added unless the customer's quotation or invoice states otherwise.
8. Report Timescale
MSS will normally issue the completed Roof Condition Report within 3 working days of receiving payment. This is a normal target rather than a guaranteed deadline. If an unusual circumstance is likely to cause a material delay, MSS will inform the customer.
9. Cancellation and No-Charge Policy
MSS does not currently charge a customer cancellation, rescheduling or failed-access fee. The customer should nevertheless give as much notice as reasonably possible if an appointment needs to change.
This voluntary no-charge policy does not reduce or replace any statutory cancellation rights the customer may have.
10. Consumer Right to Cancel
Where a consumer enters into a distance or off-premises service contract, they will normally have 14 days from the day after the contract is made to cancel without giving a reason, subject to applicable law.
The customer may cancel by sending MSS a clear statement by email or post. A model cancellation form is included at the end of these terms, but use of that form is not compulsory.
If the customer asks MSS to carry out the inspection during the 14-day cancellation period, MSS will obtain the customer's express request to begin the service during that period. The customer will also be asked to acknowledge that, once the service has been fully performed, the statutory right to cancel may be lost.
MSS's current commercial policy is not to charge a cancellation fee. Nothing in these terms is intended to restrict any consumer right that cannot lawfully be restricted.
11. Early-Performance Request
For an inspection booked to take place during the 14-day cancellation period, MSS may ask the customer to confirm: "I expressly request that Marshall Surveying Solutions begins providing the inspection service during my 14-day cancellation period. I understand that once the service has been fully performed, I may lose my statutory right to cancel."
12. The Roof Condition Report
The report is prepared for the customer named in the report for the purpose described in the inspection instruction. It is a visual roof condition report based on the photographic and/or video evidence reasonably obtainable during the drone inspection. It is not a structural survey, building survey, valuation, invasive investigation, guarantee of watertightness, guarantee of future performance, or confirmation that the roof is free from defects.
Findings and recommendations reflect the visible evidence available to MSS at the time of inspection. Concealed, intermittent or developing defects may not be identifiable from that evidence. Where the cause, extent or significance of a condition cannot reasonably be established visually, MSS may recommend monitoring, opening-up, testing or further investigation by an appropriately competent contractor or specialist. The report should be read as a whole, including its photographs, limitations and recommendations; individual photographs or comments should not be taken out of context.
13. Roofing Quotations and Contractor Referrals
Unless expressly agreed otherwise, MSS provides an independent roof inspection and condition-report service and does not undertake roofing repairs as part of the inspection fee.
Where MSS provides details of a roofing contractor or other third party, the customer remains free to choose whether to contact or appoint that contractor. Any referral fee, commission or other material benefit received by MSS in connection with a referral will be disclosed to the customer where applicable. A referred contractor remains responsible for its own quotation, work, advice, insurance and contractual obligations.
14. Photographs, Video and Privacy
MSS may capture photographs and video necessary to carry out the inspection and prepare the report. Reasonable care will be taken to focus capture on the instructed property and relevant roof areas. Incidental capture of neighbouring property or people may sometimes be unavoidable.
Inspection media and customer information will be handled for legitimate business purposes including inspection delivery, record keeping, quality assurance and responding to queries. MSS will not knowingly publish identifiable customer information or property-specific inspection material for marketing without an appropriate lawful basis and, where appropriate, permission.
15. Professional Standard and Liability
MSS will provide the service with reasonable care and skill. Nothing in these terms excludes or limits liability where it would be unlawful to do so, or restricts the customer's statutory rights.
MSS is responsible for carrying out the agreed visual, non-intrusive inspection and reporting on matters that could reasonably be identified from the visual evidence obtained within the agreed scope. MSS is not responsible for hidden, concealed, intermittent or developing defects, or for conditions that could not reasonably have been identified from that evidence.
The customer should not treat the report as a guarantee that the roof is watertight, defect-free or suitable for any particular future period. Where MSS recommends further investigation, specialist advice, repair or monitoring, the customer is responsible for deciding whether and when to act on that recommendation. Any financial limitation or cap on liability will apply only if expressly agreed in the customer's contractual documents and only to the extent permitted by law.
16. Complaints
If the customer is dissatisfied with the service, they should contact MSS as soon as reasonably possible using the contact details above, explaining the issue and providing any relevant information. MSS will review the matter and seek to respond fairly and promptly.
17. Changes to the Inspection
If the customer asks for a material change or additional work outside the quoted scope, MSS will explain any effect on price or timescale before carrying out that additional work where reasonably practicable.
18. Governing Law
These terms are governed by the law of England and Wales. Nothing in this clause removes any mandatory consumer right concerning the courts or law applicable to the customer.
MODEL CANCELLATION FORM
Complete and return this form only if you wish to cancel the contract. You may instead cancel by any other clear statement.
